Welcome to ServiceNomadOS. These Terms of Service ("Terms") govern your access to and use of the ServiceNomadOS software platform, website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, you may not use the Service.

2. Service Description

ServiceNomadOS provides cloud-based business management software designed for RV repair shops and mobile technicians. Our Service includes features for scheduling, dispatching, work orders, invoicing, customer management, communication tools, and integrations with third-party services.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We may also impose limits on certain features or restrict access to parts of the Service without notice or liability.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

3.2 Account Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscription and Billing

4.1 Subscription Plans

ServiceNomadOS offers various subscription plans with different features and pricing. Current pricing is available on our website. We reserve the right to change our pricing with 30 days' notice.

4.2 Billing

Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. By providing payment information, you authorize us to charge your payment method for all fees. You are responsible for all applicable taxes.

4.3 Free Trial

We may offer a free trial period. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

4.4 Cancellation and Refunds

You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. We do not provide refunds for partial months or years, except as required by law.

4.5 Payment Processing Fees

When you process customer payments through our Service, standard payment processing fees apply (currently 2.9% + $0.30 per transaction). These fees are subject to change based on our payment processor's rates.

5. User Responsibilities and Conduct

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Use the Service for fraudulent or illegal purposes
• Reverse engineer, decompile, or disassemble the Service
• Rent, lease, or resell the Service
• Remove or modify any copyright or proprietary notices
• Use automated systems (bots, scrapers) without permission

6. Communications Compliance

6.1 SMS and Email Communications

When you use ServiceNomadOS to send SMS or email communications to your customers, you are acting as the sender and are solely responsible for compliance with all applicable laws, including:

• Telephone Consumer Protection Act (TCPA): You must obtain prior express written consent before sending marketing text messages
• CAN-SPAM Act: You must include accurate sender information, clear subject lines, and opt-out mechanisms in emails
• State Laws: You must comply with applicable state telemarketing and privacy laws

6.2 Consent Requirements

You are responsible for:

• Obtaining and documenting proper consent from recipients
• Honoring opt-out requests promptly
• Maintaining records of consent for at least 4 years
• Including required disclosures (message frequency, standard rates apply, etc.)

6.3 Prohibited Content

You may not use our communication features to send:

• Spam or unsolicited messages
• Illegal, threatening, or harassing content
• Phishing or fraudulent messages
• Content that violates intellectual property rights

6.4 Violations and Suspension

We reserve the right to suspend or terminate your account if we determine you are violating communications laws or our policies. You agree to indemnify us against any claims arising from your use of communication features.

7. Your Data and Content

7.1 Ownership

You retain all ownership rights to the data and content you upload to the Service ("Your Data"). This includes customer information, work orders, invoices, and any other content you create or store.

7.2 License to ServiceNomadOS

You grant us a limited license to use, store, and process Your Data solely to provide and improve the Service. We will not sell, share, or use Your Data for any purpose other than operating the Service, except as required by law.

7.3 Data Backup and Security

While we implement security measures and perform regular backups, you are responsible for maintaining your own backup copies of Your Data. We are not liable for data loss or corruption.

7.4 Data Export and Deletion

You may export Your Data at any time through the Service. Upon account termination, we will delete Your Data within 30 days, unless we are required to retain it for legal purposes.

8. Intellectual Property Rights

The Service, including all software, designs, text, graphics, logos, and other content (excluding Your Data), is owned by ServiceNomadOS and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

"ServiceNomadOS" and our logo are trademarks of ServiceNomadOS. You may not use our trademarks without prior written consent.

9. Third-Party Services and Integrations

Our Service may integrate with third-party services such as QuickBooks, payment processors, SMS providers, and others. Your use of these services is subject to their respective terms and conditions. We are not responsible for third-party services or any issues arising from their use.

We may display links to third-party websites. These links are provided for convenience only, and we do not endorse or assume responsibility for third-party content.

10. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors will be corrected
• The Service will meet your requirements

Your use of the Service is at your sole risk. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SERVICENOMADOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the limitation of liability for personal injury or incidental/consequential damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless ServiceNomadOS, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws or regulations
• Your violation of any third-party rights
• Your use of communication features (SMS, email)
• Your Data or content

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing a formal claim, you agree to contact us at rvtechs@servicenomad.ai to attempt to resolve the dispute informally. We will work in good faith to resolve the matter within 60 days.

13.2 Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall take place in [Your State/Location].
